Legal definition of “special food”


Special foods are intended for specific groups of people and must meet specific nutritional requirements, such as those of sick people, pregnant women, young children or infants. Until now, all requirements for special foods were regulated in the Dietetic Food Regulation (Dietary Framework Directive 2009/39/EC). After more than thirty years, this concept was abandoned in European law and replaced by new European regulations for foods for specific consumer groups (Regulation (EU) 609/2013) as of 20 July 2016. This specifies that foods for special groups must be suitable for the stated nutritional purpose and must be clearly distinguishable from foods for general consumption because of their composition. As well as foods for infants and young children (infant formula, follow-on formula and complementary foods), special foods for special medical nutritional purposes (balanced diets), and for people who want to reduce their body weight by eating calorie-reduced foods (meal replacements, daily rations) also fall within the scope of the regulation.
